Terms of Service

1. Acceptance of Terms

By creating an account, purchasing a hosting plan, or using any service provided by NiceHostings, you agree to comply with and be legally bound by these Terms of Service, our Privacy Policy, and our Refund Policy. These terms apply to all users, including visitors, customers, and registered account holders.

NiceHostings reserves the right to modify these terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.

2. Account Registration

To use our services, you must register an account. You agree to:

• Provide accurate, complete, and up-to-date information during registration
• Maintain the security of your account credentials and not share them with third parties
• Notify us immediately at [email protected] of any unauthorized access or security breach
• Accept full responsibility for all activity that occurs under your account

You must be at least 18 years of age to register an account. NiceHostings reserves the right to terminate accounts that provide false or misleading information.

3. Acceptable Use Policy

3.1 Prohibited Content

You may not use our servers or services to host, transmit, distribute, or store any content that:

• Is illegal under Pakistani, US, or international law
• Infringes on any third-party intellectual property, trademark, or copyright
• Contains malware, viruses, spyware, ransomware, or any harmful code
• Is defamatory, harassing, threatening, or abusive
• Constitutes spam, phishing, or unsolicited bulk email
• Contains child sexual abuse material (CSAM) — strictly prohibited and reported to authorities
• Is related to illegal gambling, narcotics, or unauthorized weapon sales

3.2 Prohibited Activities

You may not use our services to:

• Conduct DDoS attacks, port scanning, or any network abuse
• Mine cryptocurrency without written authorization from NiceHostings
• Run anonymous proxy or VPN services that disguise illegal activity
• Attempt to gain unauthorized access to any system or network
• Violate the terms of any third-party service you access through our platform

Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

4. Service Plans & Billing

4.1 Pricing

All prices are listed in US Dollars (USD) unless otherwise specified. Pricing is subject to change; however, existing customers will be notified at least 30 days before any price changes affecting their active subscriptions.

4.2 Billing Cycle

Services are billed in advance on a monthly or annual basis depending on the plan selected. Annual plans are billed in full at the start of the billing cycle. Failure to pay on time may result in service suspension.

4.3 Renewal

Services renew automatically at the end of each billing period unless cancelled at least 48 hours before the renewal date. You are responsible for cancelling services you no longer require.

4.4 Taxes

Prices shown may exclude applicable taxes. Any taxes, duties, or levies imposed by governmental authorities are the responsibility of the customer.

5. Service Level Agreement (SLA)

NiceHostings commits to the following uptime guarantees for its services:

• Shared Hosting: 99.9% uptime guarantee
• VPS Hosting: 99.95% uptime guarantee
• Dedicated Servers: 99.99% uptime guarantee

Downtime caused by scheduled maintenance, customer actions, DDoS attacks, or force majeure events is excluded from SLA calculations. In the event of an SLA breach, customers may be eligible for service credits as defined in their plan details. Credits are the sole remedy for SLA violations and will not exceed one month of service fees.

6. Resource Usage

Shared hosting plans are subject to fair usage policies. Accounts that consume excessive server resources (CPU, RAM, disk I/O) that negatively impact other users may be suspended or required to upgrade to a higher-tier plan. We reserve the right to define what constitutes "excessive usage" and to take action accordingly.

Disk space and bandwidth advertised as "unlimited" are subject to our fair usage policy and may not be used for file storage unrelated to web hosting purposes (e.g., remote backups, video/media archives).

7. Account Suspension & Termination

7.1 By NiceHostings

We reserve the right to suspend or terminate your account at any time, with or without notice, if:

• You violate any provision of these Terms of Service
• Payment fails and is not resolved within 7 days of the due date
• Your account is involved in abusive, fraudulent, or illegal activity
• We receive valid legal orders requiring suspension

7.2 By You

You may cancel your account at any time by submitting a cancellation request through our support portal or by emailing [email protected]. Please refer to our Refund Policy for applicable refund terms upon cancellation.

7.3 Data After Termination

Upon account termination, your data will be deleted from our servers within 14 days. It is your responsibility to maintain backups of your data. NiceHostings is not liable for any data loss resulting from account termination.

8. Backups

NiceHostings performs periodic server-level backups as a courtesy on shared and WordPress hosting plans. However, these backups are not guaranteed and should not be relied upon as your sole backup solution. You are solely responsible for maintaining independent backups of your data. NiceHostings is not liable for data loss under any circumstances.

9. Intellectual Property

All content on the NiceHostings website — including logos, design, software, and documentation — is the exclusive property of NiceHostings and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any of our materials without prior written consent.

You retain full ownership of all content you upload to our servers. By using our services, you grant NiceHostings a limited, non-exclusive license to store and serve your content as necessary to provide the services.

10. Limitation of Liability

To the fullest extent permitted by law, NiceHostings shall not be liable for:

• Loss of data, revenue, profits, or business opportunity
• Indirect, incidental, special, or consequential damages
• Damages arising from third-party services, software, or integrations
• Any interruption or failure of service beyond our reasonable control

Our total liability to you for any claim arising from use of our services shall not exceed the total fees paid by you in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless NiceHostings, its officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the services, violation of these terms, or infringement of any third-party rights.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Pakistan. For international customers, these terms shall also conform to applicable consumer protection laws of your jurisdiction.

13. Changes to These Terms

We may revise these Terms of Service periodically. When we do, we will update the "Last Updated" date at the top of this page and, where appropriate, notify customers via email. Your continued use of our services after changes take effect constitutes your acceptance of the revised terms.
